RTE Amendment Bill Lok Sabha today passed the bill that allow education institutes to detent students in classes 5th and 8th. HRD minister Prakash Javadekar moved this bill forward about the revocation of ‘no detention’ policy in classes 5 and 8. But now with this new amendment allows school to fail students in class 5 and 8 if they fail or withhold their promotion to next class.

Human Resource Development Minister Prakash Javadekar moved the ‘The Right of Children to Free and Compulsory Education (Second Amendment) Bill, 2017’, which sought for regular examination in classes 5 and 8.

The RTE Act, when it was passed in 2009, brought in a no detention policy. Introducing the amendment in the house, Human Resources Development minister Prakash Javadekar said the demands for the repeal of the no detention policy was made by many states and Union Territories in recent years following poor marks by students. RTE Amendment Bill He said the Bill was necessitated by the lowering of learning outcomes.

The original Act stipulated that no child admitted in a school shall be held back in any class or expelled from school till the completion of elementary education. The amended Act will now have provisions not only for examination in both these classes, but will also extend powers to the state to hold back children, if they fail in re-examination– also provisioned in the amended Bill.
